The CaseProof ® General Terms and Conditions

1. Preamble


The site is the property of CaseProof ® in its entirety, as well as all the rights relating to it. Any reproduction, in whole or in part, is systematically subject to the authorization of the owners.

2. Acceptance of the conditions

The customer acknowledges having read, at the time the order is placed, the special conditions of sale set out on this screen and expressly declares that he accepts them without reservation. The present general conditions of sale govern the contractual relations between CaseProof ® and its customer, both parties accepting them without reserve.

These general conditions of sale will prevail over all other conditions appearing in any other document, except prior, express and written derogation.
If a condition should be lacking, it will be considered to be governed by the practices in force in the distance selling sector whose companies have their registered office in France.

3. The products

The products offered for sale are those described on the site CaseProof.net The photographs illustrating the products offered for sale are out of the contractual field. If errors have been introduced, in no case, the responsibility CaseProof ® can not be held liable.

4. Order

Automatic recording systems are considered as proof of the nature, content and date of the order. CaseProof ® confirms the acceptance of the order to the customer at the e-mail address he will have communicated. The sale will be concluded only as from the confirmation of the order. The information given by the buyer, when taking the order, is binding for the buyer: in case of error in the wording of the addressee's details, the seller cannot be held responsible for the impossibility to deliver the product.

The customer can at any time follow the progress of his order in his customer area. All orders placed on CaseProof ® are intended for the personal use of customers, customers or recipients of products are prohibited from any partial or total resale of products.

CaseProof ® also reserves the right to refuse any order from a customer with whom there is a dispute over payment of a previous order. In order to reduce our impact on the environment, we do not send you a paper invoice, you have the option to print your invoice.

5. Availability and prices

CaseProof ® reserves the right to modify its prices at any time, knowing that the products will be invoiced on the basis of the rates in force at the time of the order registration. The price indicated on the product sheets does not include shipping costs. These are offered as soon as the order reaches 100€ of purchases, per order, in Metropolitan France only. The price indicated in the order confirmation is the final price.

CaseProof ® reserves the property of the goods until the full amount of the order is received. VAT: Company subject to value added tax and identified by the number FR 03504141201, registered in the Trade and Companies Register of La Roche sur Yon.

6. Delivery


6.1 Delivery areas


Delivery is made in metropolitan France and Corsica, subject to the provisions mentioned below. The products will be sent to the delivery address that the customer will have indicated during the ordering process.

6.2 Modes of delivery

Once the package is prepared, it will be delivered to you within an indicative period of 48 hours, directly to your mailbox. If it is not big enough and you are absent, a delivery notice will be left with you, allowing you to choose on the Internet a new delivery date within 6 working days or to pick up your parcel the next day at 3pm at the post office of your choice.
If you do not express a choice, you will then be able to recover your parcel in your home post office, within 15 days.
Follow the delivery of your package at any time on www.laposte.fr.

TNT - home

The package is hand-delivered to the customer. If the customer is absent, it will be made available to him/her at the nearest relay point. The customer thus has 15 working days from the arrival of his package to come and collect it. After this period, it will be returned to the sender.

6.3 Delivery times and costs


CaseProof ® processes orders from Monday to Friday (except public holidays), with an average turnaround time of 48 hours. At certain periods (in particular during sales, black friday, christmas, private sales), the processing time may be longer due to the greater number of orders to be processed.
In addition to this time, transport times must be added, as orders are delivered by the parcel service of La Poste or TNT.
The maximum delivery time, including transport, is 15 working days from the date of validation of the order, unless otherwise expressly stipulated before placing the order and prior to the final validation of the order.
In all cases, the customer automatically receives an email informing him/her of the shipment and the follow-up of his/her order.
Each delivery will be deemed to have been made as soon as the product has been made available to the customer, by the post office or by the carrier.

  • Via Colissimo Domicile: 6,90€ TTC, at home without signature, in 48h working days. (Except Corsica). 
  • Via TNT : 13 € TTC, at home in 24h, if order placed before 1pm. (Excluding Corsica 6.4 Liability

In case of apparent defects, the buyer has the right to return the goods under the conditions provided for in this document. War, riot, fire, fire, strikes, accidents, bad weather and the impossibility of being supplied are considered as cases of force majeure discharging the seller from his obligation to deliver.

The goods always travel at the recipient's own risk. Always check your package upon arrival. You have 48 hours to make any reservations to the carrier in case of missing or damaged. For reasons of availability, an order can be delivered in several times to the customer. The customer then only pays for one delivery. If the customer wishes 2 places of delivery, he places 2 orders, with the related delivery costs.

7. Delivery times and international delivery


7.1 Types of delivery


International Post

Packages are delivered by the Post Office or by a carrier to the address indicated at the time of ordering. As such, CaseProof ® is not able to guarantee a precise delivery time. The parcel is hand delivered to the customer or delivered in his letter box. If its size does not allow a delivery in a letter box, it will be made available to the customer in the post office to which it is attached. The customer thus has 15 working days after the arrival of his parcel at the post office to collect it. After this period, it will be returned to the sender.

Mondial Relay - relay point
The customer will be informed of the availability of his package by email, notifying him to come and collect it at a relay point within 15 working days.
After this period, the package will be returned to the sender.

7.2 Delivery times and costs

Via Colissimo Europe: 9.90€ TTC at home with signature, in 4/7 working days. 

REST OF EUROPE

Via Colissimo Expert International: 14.50€ including VAT at home with signature, in 4/10 working days.

REST OF THE WORLD + DOM TOM

Via Colissimo Expert International: 20€ including VAT at home with signature, in 4/10 working days.

Outside the European Union, customs charges may be applied and are at the customer's expense.

8. Secure Payment

The products are payable in cash on the day of the effective order. The payment is made by Paypal, according to the SSL protocol secure payment service by credit card (CB, Visa, MasterCard, American Express...).

With Paypal your financial information is not communicated to us under any circumstances. The information that transits between your computer and the website is encrypted and therefore impossible to read by a third party.

9. Withdrawal

According to article L. 121-20 of the Consumer Code, you have 30 clear days from receipt of your order to return it to us, the return costs being at your expense.

In case of exercise of the right of retraction, please send an e-mail to contact@caseproof.net with your order number to obtain an exchange or a refund.CaseProof ® will remind you the exact address for the return of the articles. It is imperative that you enclose the return form duly completed with your package. Only products returned in their entirety and in perfect condition for resale (in their original packaging, unworn, unwashed) will be taken back.

Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged. In case of exercise of the right of withdrawal, CaseProof ® will make every effort to reimburse the customer within 30 days. CaseProof ® is in no way responsible for lost returns. You are therefore advised to return the package with acknowledgement of receipt for more security.

10. Applicable Law/Litigation

The present general conditions of sale are subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction.

If these general terms and conditions of sale were to be translated into a foreign language, only the French version would be authentic. In the event of difficulty or complaint regarding an order, the customer may contact Customer Service to find an amicable solution.

Failing this, the Commercial Court of La Roche sur Yon shall have sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

11. Information Technology and Freedoms

The personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and routing of orders, the establishment of invoices and warranty contracts. Failure to provide this information will result in the non-validation of the order.

In accordance with the Data Protection Act, the processing of personal information relating to customers has been declared to the National Commission for Information Technology and Civil Liberties.

The customer has a right of access, modification, correction and deletion of data concerning him, which he can exercise with CaseProof ®.

Moreover, CaseProof ® undertakes not to communicate, free of charge or with compensation, the details of its clients to a third party.

12. Intellectual Property

All the texts, comments, illustrations and images appearing on the CaseProof ® site are reserved under copyright and intellectual property. Any other use would constitute an act of counterfeiting, punishable under the conditions provided by the Code of Industrial Property.
